In Texas, this is a third degree felony. Possession of Child Pornography Possession of Child Pornography happens when an individual knowingly or intentionally possesses visual material depicting a minor engaged in sexual conduct. The level of offense depends on many factors but can range from a third to first degree felony. Defenses to Internet Crimes in Texas Texas law enforcement takes internet crimes very seriously, and those who are accused of breaking the law can face serious penalties if found guilty. However, defendants may have certain legal defenses available to them that could help mitigate their sentence or exonerate them completely from the charges. Here are some of the more common legal defenses used in Texas for internet crime cases involving Online Solicitation of a Minor, Possession of Child Pornography, and Online Impersonation: Online Solicitation of a Minor In most online solicitation cases, the prosecution must prove that the defendant had a specific intent to commit an illegal act. This means they must demonstrate beyond reasonable doubt that the defendant was fully aware they were engaging in criminal activity. The defense may be able to refute this by showing the accused was not actually trying to solicit a minor, but instead was engaged in a consensual activity or simply joking around. Possession of Child Pornography In these cases, the prosecution must prove that the defendant knowingly possessed illegal material involving minors. However, defendants may have an alibi defense available if they did not have access to the computer/device where child pornography was found or if someone else had access and could have downloaded it without their knowledge. The defense could also argue that the images were for legitimate artistic purposes or for educational research. Online Impersonation The defense may be able to argue that the person being impersonated gave consent or condoned it as harmless fun. Additionally, the impersonator may be able to show that they intended no harm to the victim and were not trying to defame, threaten or blackmail them. The defense could also argue that the conduct does not meet the legal definition of online impersonation in Texas. In order for these defenses to be successful, defendants must have an experienced and knowledgeable attorney who can present their case in a compelling manner. If you are facing charges related to internet crimes in Texas, it is important that you speak with an experienced attorney who can understand your situation and ensure your rights are protected. Imagine you are diagnosed with a brain tumor that needs to be removed. Would you seek treatment from a cardiologist? Of course not. Just as every medical doctor has an M.D. at the end of their name, every lawyer has a J.D. While there are generalist lawyers, just as there are generalist doctors, many lawyers specialize in a particular area of law. Among criminal lawyers, those who are Board Certified in Criminal Law are considered experts in the field. If you are facing criminal charges, your life is on the line. Even seemingly minor offenses, such as marijuana possession, can have long-term consequences. You need an expert to guide you through the legal process, explain your situation and the potential consequences, provide expert advice on the best course of action, and fight aggressively on your behalf. Don't take any chances with your future – hire a Board Certified Criminal Law expert to represent you. What Does it Mean to Be Board Certified in Criminal Law? Less than .008% of Texas attorneys are Board Certified in Criminal Law, making it a rare and highly coveted distinction. While you may come across many badges of honor on attorney websites, such as "Top" or "Super," the only credential you can trust as a mark of expertise is Board Certification. This credential is granted by the State Bar and signifies that other experts have reviewed the attorney's experience, investigated their reputation among judges and their peers, and tested their knowledge through a full-day exam that is even more difficult than the bar exam. Other credentials may be purchased for a fee, but Board Certification can only be earned through hard work, experience, and the respect of others in the field. When you choose a Board Certified Criminal Law attorney, you can be confident that you are getting an expert who has proven their knowledge and skills in the field. How Does a Lawyer Become Board Certified? It is a difficult and highly selective process to become Board Certified in Criminal Law. In fact, only .008% of lawyers have passed the Board Certification Exam. However, it is completely voluntary, and only those attorneys who are truly dedicated to their practice even attempt it. To apply, the attorney must first meet the minimum requirements set by the Texas Board of Legal Specialization, which is a significant amount of work in and of itself. Do not be fooled by the word "minimum" – achieving Board Certification requires a significant investment of time and effort. To become Board Certified in Criminal Law, an attorney must meet the following requirements: Be licensed to practice law for at least five years (Brad Thornton has over a decade of experience) Devote a significant portion of their practice to criminal law in the past three years (Brad Thornton has devoted 100% of his practice to criminal law) Have experience handling a variety of criminal law matters, including jury trials, motions, and appeals Attend criminal law continuing education seminars regularly to stay up to date on legal training Be evaluated by at least ten lawyers and judges who practice criminal law and can speak to their experience and expertise Pass a day-long written examination covering state and federal criminal law. Wanna know more? Consent in Texas The key aspect of the offense is the lack of consent, which can be indicated by a number of factors. In this article, we will discuss several ways in which the law defines sexual assault as being "without consent." One way that a sexual assault can be considered "without consent" is if the victim is incapacitated. This can include situations in which the victim is unconscious, asleep, or otherwise unable to give clear and willing consent due to the influence of drugs or alcohol. Additionally, a person who is under the influence of a controlled substance that renders them unconscious or unable to resist, or incapacitated by any other means, is considered unable to give consent. Sex Offender Registration and Collateral Consequences A conviction for sexual assault can have serious and long-lasting consequences, both legally and socially. One of the most significant collateral consequences of a sexual assault conviction is the requirement to register as a sex offender. Sex offender registration is a system that requires individuals convicted of certain sexual crimes to provide their personal information, such as their name, address, and photograph, to be publicly available in a sex offender registry. This information is accessible to the public, and can be searched by anyone through the Internet. In Texas, anyone convicted of sexual assault must register for life as a sex offender. This means that for the rest of their lives, their personal information will be readily available to anyone who wants to access it, and they will be subject to strict restrictions on where they can live and work. Being on the sex offender registry can have a profound impact on an individual's life. It can be difficult to find a job, housing, or even to maintain relationships with friends and family. Landlords or employers are often hesitant to rent or hire someone on the registry, and many areas have strict restrictions on where convicted sex offenders can live or work. Additionally, sex offender registration can also affect an individual's rights to vote, possess firearms, or hold public office. Another potential collateral consequence of pleading to sexual assault in Texas is the negative impact it can have on an individual's reputation, regardless if the person is guilty or not. A sexual assault conviction can affect an individual's education, career and overall social status. Even if the person is acquitted or if the case is dismissed, that person might be stigmatized, and the accusation could affect their reputation for the rest of their lives. It is important for anyone facing a sexual assault charge to understand the potential consequences of a conviction, and to seek the guidance of an experienced criminal defense attorney who can help them make informed decisions about their case. An attorney can help you navigate the complex legal process, and may be able to negotiate a plea bargain that reduces the charges and potential penalties, or work towards getting the case dismissed. However, just because someone is accused of sexual assault does not necessarily mean that they are guilty. There are a number of defenses that can be used to fight a sexual assault charge. One of the most common defenses to a sexual assault charge is consent. Consent is a legal term that refers to a freely given agreement to engage in sexual activity. In Texas, if the alleged victim consented to the sexual activity, then the accused cannot be found guilty of sexual assault. However, it is important to note that consent cannot be given by someone who is incapacitated, such as someone who is unconscious, under the influence of drugs or alcohol, or who has a mental or developmental disability. The defense of consent can be complex and requires a thorough understanding of the facts of the case, as well as a thorough examination of the evidence. It is crucial for the defendant to have an experienced criminal defense attorney that can help them build a strong defense based on consent. Another common defense to sexual assault is an alibi. An alibi is a defense that an accused person was not present at the scene of the crime at the time it occurred. In order to establish an alibi, the accused person must provide evidence to support their claim that they were somewhere else at the time of the alleged assault. This evidence can include things like witness testimony, video surveillance, or other forms of physical evidence. The defense of alibi can be difficult to establish, as it requires the accused person to prove that they were not present at the scene of the crime. However, if an accused person can provide clear and convincing evidence of an alibi, it can be an effective defense against a sexual assault charge. It is important to note that defenses can vary depending on the specific case, and other defenses may be more suitable depending on the facts of the case. If you or someone you know has been accused of sexual assault in Texas, it is important to seek the guidance of an experienced criminal defense attorney who can help you understand your rights, the potential consequences of a conviction, and the different defenses that may be available in your case. A good attorney will conduct a thorough investigation, gather evidence and interview witnesses to help you build a strong defense and defend your rights. When you are looking for a DWI Lawyer in San Antonio DWI attorney, Brad has the experience you need on your side. FREE CONSULTATION Intoxication Assault in San Antonio, Texas In Texas, Intoxication Assault is a third-degree felony charge that carries serious consequences. This offense is defined as causing serious bodily injury to another person while operating a motor vehicle while intoxicated — and at least one of the parties involved, other than the person charged with the crime, must have sustained serious injuries as a result of the defendant’s actions. It’s important to note that even if you didn’t intend to cause harm, you can still be charged with Intoxication Assault in Texas. Prosecutors take intoxication assault very seriously in Texas, because it’s a serious offense that can have life-altering consequences for the victim. The state views this crime as one of the most egregious forms of drunk driving and carries heavy penalties as a result. For example, if convicted, you could be looking at up to 10 years in prison and/or fines of up to $10,000. You may also face additional charges such as medical expenses for any victims involved — which could skyrocket depending on the severity of the injuries sustained. If you find yourself facing an Intoxication Assault charge in Texas, it is crucial that you seek legal counsel right away. An experienced criminal defense attorney can help you understand the charges and laws associated with your case, guide you through the legal process, and even explore options to reduce or dismiss the charges against you. In addition, it’s important to remember that Intoxication Assault is a felony charge and could have long-term implications on your life — so it’s essential that you take these charges seriously and do not act without consulting an attorney first. Elements of Intoxication Assault in San Antonio The Texas Penal Code Section 49.07 defines Intoxication Assault as operating a motor vehicle in a public place while intoxicated and causing serious bodily injury to another person. Serious bodily injury is defined as an injury that creates a substantial risk of death or that causes serious and permanent disfigurement or loss/impairment of the function of any body part or organ. Some examples include severe broken bones, head trauma, paralysis and nerve damage. For someone to be charged with Intoxication Assault in Texas, at least one victim must have suffered from one or more of these kinds of injuries. Under Texas law, intoxication is defined in two ways: by the amount of alcohol in your blood and/or by your mental or physical state. The legal limit for a blood alcohol concentration (BAC) level is 0.08%, but you can still be considered intoxicated if your BAC is below this limit — if the officer can show that you have lost the normal use of your mental and physical faculties. You can also be charged with Intoxication Assault in Texas even if you weren’t under the influence of alcohol; if drugs are found in your system — whether illegal substances or prescription medication — that could lead to criminal charges as well. Defenses for Intoxication Assault in San Antonio The most common defense for Intoxication Assault in Texas is that the accused was not actually intoxicated. For example, even if a breath or blood test can show that the defendant had a BAC over 0.08%, the lab information can be reviewed by an expert who can show the jury how the result shouldn’t be trusted. Additionally, a defense attorney may also argue that there is insufficient evidence to prove that an injury occurred due to the defendant’s alleged intoxication — meaning they should not be held criminally liable for their actions. This is called challenging the “causation” and is one of the most common defenses. Other defenses may include challenging the proper administration of the field sobriety tests, lack of probable cause to detain you and investigate, and/or issues regarding Miranda rights. Punishment for Intoxication Assault in Texas The potential punishments and consequences for Intoxication Assault in Texas can vary depending on the circumstances of the case. Generally, Intoxication Assault is a third-degree felony offense and is punishable by up to 10 years in prison and/or a fine of up to $10,000. Additionally, your driver's license may be suspended or revoked due to an Intoxication Assault conviction. There may also be other collateral consequences such as difficulty obtaining employment or rental housing due to having a criminal record. He was able to support in getting my case dismissed in less than 2 months and was attentive and personable during the whole process. You have a choice when deciding who’s going to represent you, and to have an attorney that genuinely cares for his clients should be an expectation anyone should set. Brad will meet that expectation 110%! Kevin E. Jourdanton, Texas [Brad] made the process very easy for me, handling everything within a month, with a motion to dismiss all cases against me. I only had to attend court once! The portal he uses to make sure you are aware of everything going on in your case is awesome, I didn’t even have to worry everything got downloaded to the portal with email notifications. I would never use another attorney to represent me, he is the best at what he does. WHAT PEOPLE ARE SAYING
