License Suspension for DWI in San Antonio, Texas


If you find yourself charged with DWI in San Antonio, you need to know that a driver’s license suspension is coming your way. There may still be time to fight the suspension and you need an experienced DWI attorney on your side. Notice that I said “DWI” attorney. Many lawyers can handle criminal charges, including DWI. But there are many complications specific to DWI that require an attorney with extra experience with these cases. Driver’s license suspensions are one of them.


If you are arrested for DWI in San Antonio, your license will likely be suspended. There are ways to fight this suspension, but time is of the essence. You can request a hearing known as an Administrative License Revocation (ALR) hearing. In you hire Thornton Criminal Defense, we can request this hearing for you and handle all the details. If fifteen days have already passed, we can still help with restoring your ability to drive.



ALR Hearing Information


  1. You must request a hearing within 15 days of your arrest for DWI.

  2. Your hearing will be scheduled typically 6 months after your request and your license will not be suspended during this time.

  3. ALR hearings are not required to be attended by you, but the officer is required to attend: if he doesn’t and was properly subpoenaed to attend, your license will not be suspended.

  4. If the officer does show up, it is an excellent chance for us to cross-examine the officer about details about your case. Since the prosecution will not be there, this gives us a great chance to get ahead of the game.

  5. If the officer shows and we lose the hearing, your license will be suspended. But all is not lost. We can still work with you to get an occupational drivers license that allows you to drive to work during this time.


How Long is the License Suspension for DWI


If you took a either a breath or blood test during your arrest and failed, DPS will attempt to suspend your license. Here are the potential periods of suspension:

·        First DWI – 90 days

·        Subsequent DWI – up to two years


To encourage people to consent to a breath or blood test if they are suspected of DWI, the legislature makes the penalties for a refusal much worse. These are the potential periods of suspension for those who refuse:

·        First DWI – 180 days

·        Subsequent DWI – mandatory 2 years
