ALR Hearing Information
- You must request a hearing within 15 days of your arrest for DWI.
- Your hearing will be scheduled typically 6 months after your request and your license will not be suspended during this time.
- ALR hearings are not required to be attended by you, but the officer is required to attend: if he doesn’t and was properly subpoenaed to attend, your license will not be suspended.
- If the officer does show up, it is an excellent chance for us to cross-examine the officer about details about your case. Since the prosecution will not be there, this gives us a great chance to get
- ahead of the game.
- If the officer shows and we lose the hearing, your license will be suspended. But all is not lost. We can still work with you to get an occupational drivers license that allows you to drive to work during this time.
How Long is the License Suspension for DWI?
If you took a either a breath or blood test during your arrest and failed, DPS will attempt to suspend your license. Here are the potential periods of suspension:
- First DWI – 90 days
- Subsequent DWI – up to two years
To encourage people to consent to a breath or blood test if they are suspected of DWI, the legislature makes the penalties for a refusal much worse. These are the potential periods of suspension for those who refuse:
- First DWI – 180 days
- Subsequent DWI – mandatory 2 years
